Bidding will be conducted by the acre, with the final purchase price calculated by multiplying the winning bid by 40 acres. Any future survey will not affect the purchase price.

Property features include whitetail deer, wild turkey, morel and chanterelle mushrooms, and an old hunting cabin in poor condition that the new owner may be able to restore.

The property has been accessed by various routes over the years. The Trust does not hold any legal easement to the property. For several years, the tenant farmer has crossed two neighboring properties for access, but there is no written agreement.

The new owner will be responsible for arranging access to the farmland for farming or recreational use. Neither Schmid Auction nor the Trust guarantees access to the property.

Anyone wishing to view the property in person must arrange access with a neighboring property owner. Neither Schmid Auction nor the Trust may grant permission to cross a neighbor’s property to reach the site.

A prescriptive easement in Illinois is a legal right to use another person's private land for a specific purpose, earned by using it openly and without permission for 20 years.

The use must last for the full 20-year statutory timeframe without major breaks. Seasonal or occasional use matching the property type (like farming or hunting access) can still count if regular.

 

Easement by Necessity: This is often granted by courts when a single large property was split into smaller parcels, leaving one part without public road access. The law implies an access easement across the previously connected land.

 

You can attempt to peacefully negotiate and purchase a written right-of-way or access strip directly from an adjoining neighbor.

 

Rights: All of the Seller’s mineral, oil, and gas rights, if any, will transfer without warranty of title or title evidence.

Auction: Property subject to seller conformation.

Bidding Method: By the acre. Final purchase price will equal the high bid multiplied by the total acres which is 40. The Purchase agreement will reflect the total tract price (not per-acre price).

Bidding Increments: $25.00 per acre.

Extended Bidding: Any bid placed in the final 3 minutes will extend bidding on by 3 minutes.

Down Payment & Closing: A 10% down payment is due the following day, Wednesday, October 8. The remaining balance is due at closing, approximately 40 days after the auction. The down payment will be held in escrow by the title company. Buyers using financing should note that most banks and lending institutions will not issue loans without written legal access shown on the title commitment.

Purchase Agreement: Successful bidders must sign purchase agreements on Wed October, 8th (in person or via DocuSign).

Crops & Possession: The current farm tenant retains rights to the 2026 crop.

Condition: Real estate sells “As Is.” Buyers are encouraged to conduct independent inspections and due diligence. Maps, brochures, and field markers are approximate and for guidance only.

Announcements: Auction day announcements take precedence over printed materials.

Liability: Schmid Auction is not responsible for accidents.
