Full payment is due within 24 hours of auction close or prior to pickup. Accepted forms of payment
include guaranteed funds: Cash, check, credit card, or wire transfer. Credit cards are accepted up to $5,000
per invoice and are subject to a 3.5% convenience fee. Any invoice not paid within 24 hours may be
automatically charged to the credit card on file. Invoices totaling $100 or less may be automatically
charged. Returned checks, stop payments, or insufficient funds shall constitute prima facie evidence of
intent to defraud.

CREDIT CARD AUTHORIZATION:
By registering, Bidder authorizes Landmark Realty & Auction to store and charge the credit card on file
for unpaid invoices, applicable taxes, fees, transfer costs, shipping, storage, or administrative charges.
Bidder waives chargeback rights for authorized charges and agrees to reimburse Landmark for any
chargeback-related costs.

AUCTION FORMAT:

MAX BID: Bidders may place a confidential maximum bid authorizing the system to bid automatically
on their behalf.

SOFT CLOSE:
Any bid placed within the final minutes of an item’s scheduled closing time will automatically extend
bidding on that item by forty (40) seconds. Extensions continue until no bids are received within the
final forty (40) second period.

All property is sold AS-IS, WHERE-IS, WITH ALL FAULTS. Landmark acts as agent for the Seller and
makes no warranties. Bidder assumes all risk associated with inspection, removal, transport, and use

All firearms transfers must be completed through a licensed FFL dealer. A $35 transfer fee per firearm
applies. Purchasers must meet all federal, state, and local requirements. Firearms and ammunition are
sold AS-IS with no warranties. Buyer agrees to indemnify and hold harmless Landmark from any claims
arising from possession or use. 

All Federal Firearms License (“FFL”) transactions shall be processed exclusively through an authorized FFL dealer. A transfer fee of $35.00 will be added to the purchaser’s invoice for each firearm transferred. All purchasers are required to comply with all applicable federal, state, and local laws governing the purchase, transfer, possession, and ownership of firearms and ammunition in the state of their legal residence.

Purchasers must be at least 21 years of age to purchase any firearm and at least 18 years of age to purchase any ammunition. A valid government-issued photo identification shall be required at the time of ammunition pickup.

All out-of-state firearm purchases must be shipped to an authorized FFL dealer within the purchaser’s state of residence. All shipping costs, transfer fees, and any other associated expenses shall be the sole responsibility of the purchaser.

All FFL transfers will be conducted by appointment only at ACE in Dell Rapids, South Dakota. Purchasers must contact Colt to schedule a transfer appointment.

Landmark Realty and Auction, along with its owners, agents, and representatives (collectively, “Landmark”), make no warranties, representations, or guarantees, whether express or implied, regarding the safety, reliability, or functionality of any firearms or ammunition sold. The purchaser hereby agrees to release, indemnify, defend, and hold harmless Landmark from and against any and all claims, damages, liabilities, losses, costs, and expenses (including attorney’s fees) arising out of or related to the possession, use, malfunction, or defect of any firearms or ammunition purchased.

By placing a bid on any firearm or ammunition, the bidder acknowledges, affirms, and agrees to be bound by all terms and conditions set forth herein.

BIDDER REGISTRATION:
Bidder must be at least 18 years old. Registration is non-transferable. Bidder is responsible for all bids
placed under their account. Landmark reserves the right to deny or revoke bidding privileges at its
discretion.

BIDDING RULES:
All bids are binding and cannot be retracted. Landmark reserves the right to reopen bidding and resolve
disputes. All decisions by Landmark are final.

Up to $500,000.00 = $5,000.00

REMOVAL / SHIPPING:
No items will be released until payment is received in full. Buyer is responsible for all removal, shipping,
insurance, and related costs. Items not removed within 15 days may be deemed abandoned and resold
without refund.

ONLINE BIDDING DISCLAIMER:
Landmark is not responsible for internet disruptions, platform delays, email failures, or system
malfunctions. Bidder assumes all risks associated with online bidding.

CHOICE OF LAW & VENUE:
This Agreement shall be governed by the laws of the State of South Dakota. Venue for any dispute
shall be Minnehaha County, South Dakota.

FINAL ACKNOWLEDGMENT:
By placing a bid, Bidder acknowledges and agrees to all Terms & Conditions contained herein.
