Viewing the Properties

Interested buyers are welcome to inspect the tracts. Some tracts are active cattle operations. Please respect the property by leaving all gates exactly as you found them, avoiding disturbance to livestock, and exercising caution while viewing. Be respectful and do not damage any of the growing crops.

Tract 1 of the Stephen McQuinn Estate consists of 63+/- acres in Nodaway County, Missouri. You won’t find many properties like this one, as it is one of the few remaining open acreages just outside the city limits of Maryville, MO. This pasture farm is surrounded by residential development yet offers just enough seclusion to provide a country setting right outside of town. The rolling terrain provides impressive hilltop views overlooking Maryville, while the property sits only 1.5 miles from Northwest Missouri State University. Conveniently located along Jade Road just off Highway 71, the farm also provides quick access to Maryville and is only a short drive from Mozingo Lake. What makes this property especially exciting is the opportunity. With 63+/- acres in a location like this, the property is a blank slate for its next owner to explore the possibilities, whether that means continuing to utilize the land as pasture, creating a private recreational retreat, or exploring its potential as a development location or future homesite. Imagine building your dream home on one of the hilltops overlooking Maryville while still enjoying the space and privacy of country living. Properties with this combination of acreage, location, views, and proximity to Maryville are increasingly difficult to find. McQuinn Terms & Conditions

Wind Lease and Easement Notice

Certain properties are subject to existing wind lease and easement agreements with CR Clearing, LLC d/b/a Conception Wind Power. Based on the recorded wind documents reviewed, auction Tracts 6, 7, 8 and 9 are subject to wind agreements. Auction Tracts 1 & 5 are not included in those agreements. These agreements grant certain rights associated with the operation of the Conception Wind Project and impose certain restrictions on the affected properties.

The successful purchaser of any tract subject to a wind lease or easement agreement will acquire the property subject to the applicable agreement and will be required to assume and comply with the property owner's obligations under that agreement following closing.

Based upon guidance received from Seller's legal counsel and Constellation, the parent company of Conception Wind Power, Auction Company will provide the applicable title commitments and publicly recorded wind documents as part of the bidder information materials. Certain underlying lease documents are confidential, and Auction Company is not authorized to distribute those documents or interpret their provisions for prospective bidders.

Constellation has advised Seller that no wind turbines are currently located on the affected McQuinn parcels. The McQuinn wind agreement, which affects Tract 4 (not part of the auction) and auction Tracts 6, 7 and 8, currently generates a minimum fixed annual payment. Constellation has advised that upon separate ownership of these parcels, the payment will be prorated among the owners based upon acreage. Tract 9 is subject to a separate wind agreement and does not currently generate a wind lease payment.

Constellation has further advised Seller that the Repowering Effective Date under the McQuinn agreement occurred in July 2024 and that the current expiration date of that agreement is December 31, 2054.

The underlying wind agreements provide that portions of the property not occupied by wind facilities may continue to be used for farming, grazing and conservation purposes, subject to the terms of the applicable agreements. Prospective bidders are responsible for independently investigating the wind lease and easement matters affecting any tract and satisfying themselves as to their effect on the property prior to bidding. Neither Seller nor Auction Company makes any representation or warranty regarding whether any specific proposed structure, improvement or other non-agricultural use will be permitted under an applicable wind agreement.

Questions concerning a proposed use of an affected property, including the construction of a residence, building or other improvement, should be directed to Constellation prior to bidding. Auction Company will provide prospective bidders with the appropriate Constellation contact information upon request.
