BIDDING
- It is your responsibility to monitor your bidding account. We send out invoices the night of the auction from hello@SouthernMNAuctions.com - these are NOT spam messages. The 'from' line will simply say "hello". If there is any question as to whether you've won, go to your account and click on the Billing tab to see if you have open invoices.
- Read our detailed descriptions thoroughly. Photographs are considered part of the item description. Please use all the information provided to you to assess the value of this item before bidding. We have done our best to represent our items as accurately as possible, so please keep that in mind when placing your bids. Descriptions are deemed reliable but not guaranteed.
- All auctions close using an extended bidding format. This feature allows the auction to function like a live auction by extending the time for 2 minutes (or by such other time as Southern Minnesota Auctions determines) on any item that has active bidding within the last two minutes of that item closing. This also allows customers with slower computer connections a fair opportunity to bid by eliminating bidders who may use computer sniping software to place bids within the last second of an auction.
- Please ensure your credit card information is up-to-date.
- Bidders must be 18 years of age or older.
- Bidders MUST NOT share their password or account information with anyone. Bidders are solely responsible for bids placed on their account.
- Items are sold as-is, where-is, with no guarantees or warranties. Please keep in mind: loadout is NOT when you inspect the items you won. It is your responsibility to inspect all items PRIOR to purchase.
- Unless otherwise noted, all items on this auction have been previously owned and are considered used unless specifically listed as NEW or NEW OLD STOCK.
- By placing any bid on any item(s), you are entering into a legally binding and irrevocable contract with Southern Minnesota Auctions to purchase the item(s) in accordance with the Terms and Conditions of the Auction.
- Once a bid is placed, it cannot be canceled or retracted for any reason.
- If you have placed a bid in error (ex: $1,135 instead of $11.35), please contact us right away so we're able to adjust the bidding accordingly.
- Items with a reserve will not be sold unless the reserve price has been met. Seller has the right to remove the reserve at any time.
- At the close of the auction, active items will remain open until no bids have been received for two minutes.
- Jewelry: the hallmark found on the piece is what we use in our descriptions. We are not jewelers and will not be responsible for items that are incorrectly marked. Inspection is always encouraged. No refunds will be given after the auction ends.
- Vehicles: a ‘Test Drive’ does not equal a full mechanical inspection and will not reveal all mechanical issues. We are not mechanics. Photographs are considered part of the item description. Please use all information provided to you to assess the value of this item before bidding. As with all used vehicles, any vehicle sold on auction by Southern Minnesota Auctions may come with typical used vehicle issues, including minor mechanical issues and past due maintenance. By placing a bid on this auction, you agree to abide by these terms. No refunds will be given after the auction ends.
- If an item states "Tested and Works or Runs" in the description it means that the item was turned on by one of the Southern Minnesota Auction Staff. It DOES NOT guarantee that the item works perfectly or was tested for the exact application it is used for. Please inspect each item to know what you are buying before bidding on the item. No refunds will be given after the auction ends.
- Southern Minnesota Auctions and their respective employees (collectively, the “Auctioneer”) reserve the right to bid on an item in any auction. Southern Minnesota Auctions can bid on an item up to the reserve on the item on a seller’s behalf. Furthermore, if a registered bidder needs assistance, the Auctioneer can submit a bid for a registered bidder per the registered bidder’s instructions.
- The identity of bidders is not disclosed to ANY users or bidders, though such information is visible to the Auctioneer.
- Southern Minnesota Auctions can view all maximum bids.

- If you are unable or unsure if you'll be able to pick up or pay for your items at the close of the auction, please do not bid or arrange for someone else to pick your items up.
TITLED ASSETS
- When buying titled assets (vehicles, boats, trailers, etc.), the taxes and fees are subject to change without notice and will most likely change between the time your invoice is issued and the time we run your information through the state's computer system.
- A doc fee of $125 will be charged for all motor vehicles. A doc fee of $75 will be charged for all trailers and other titled assets.
- Please bring your driver's license and a proof of insurance along.
FIREARMS
When buying firearms from our auctions, the following rules MUST be observed:
- You may not send someone else to pick up your firearm for you - you must be present in order to fill out and sign the required paperwork.
- If purchasing a long gun such as a rifle or shotgun, you are required to provide a State-issued Photo ID for us to retain on record. Buyer must be over 18 years old.
- If purchasing a handgun, you are required to provide a Permit to Purchase or a Permit to Carry card along with your State-issued Photo ID for us to retain on record. Buyer must be over 18 years old.
- You will be subject to a NICS background check; please factor the extra time into your pickup schedule.
- Your NICS background check will be $25 for the first firearm plus $10 for each additional firearm. If paying with credit card, keep in mind the additional 4% credit card fee.
- Should you fail to pass your NICS background check, you will still retain ownership and we will auction the firearm again on your behalf. Refunds will not be issued and reserves will not be added to firearms in this circumstance.
For Shipped Firearms:
- We can ship to your local FFL if you're not in our area. We'll need to have a copy of their FFL on record BEFORE we ship.
- You will not be charged the $25 NICS fee from us, however, your FFL will charge you their fee (if applicable).
- Shipping fees will be added to your invoice after they have been calculated.
PAYMENT
- BUYER’S PREMIUM
- A 14% buyer’s premium will be charged on all items and lots. Buyer's Premium Discount of 4% if paid with Cash, Check, or Cashier’s Check.
- FORMS OF PAYMENT
- Buyer will receive an invoice via email after the close of the auction and will be payable by cash, personal check, cashier’s check, credit card, or debit card.
- Returned checks will be assessed a $20 fee in addition to any other expenses incurred in the recovery process.
- Any invoices left with a balance on the last day of pickup will be charged to the credit card on file. If the credit card on file is declined, the bidder will be banned from bidding on future Southern Minnesota Auctions sales.
- Any additional fees incurred - alternative pickups, etc. - need to be paid for IN CASH. If we charge the additional fees to your card, a 4% convenience fee will be assessed to the initial fee.
PICKUP
We are very busy, and we have a full schedule. WE DO NOT HAVE THE SPACE TO HOLD ITEMS IN OUR WAREHOUSE.
Alternative pickups:
- You MUST schedule an alternative pickup by the end of the original pickup time.
- All alternative pickups will be assessed with a $20 fee, payable in cash at time of pickup.
- Yes, even if you won your item for $1, you still need to pay the $20 fee.
- If we're holding onto your items from an auction, payment online MUST be made by credit card at the end of the original pickup time. We cannot wait for you to pay cash at the time of pickup for past auctions. We need to get our sellers paid as quickly as possible and leaving invoices open for cash payment prohibits that from happening.
- Scheduled alternative pickup needs to be by the Friday following the auction's end.
- Even if you request us to hold onto items, we have the right to refuse storage. We have a very tight schedule and we need the space cleared out according to the schedule set with the auction.
- Items that are paid for and have been held until the Friday following the auction's end will be considered abandoned. You will not be reimbursed, and the items will be returned to the seller or re-auctioned.
- If you're on vacation during pickup or are "Snowbirds" that leave the area for the season, you will need to arrange for another individual to pick up your items. Items can get lost or damaged if kept in the warehouse longer than our pickup window.
DO NOT show up out of the blue to see if you can pick up after the load out dates and assume your items are still in our possession. Our fantastic sellers promptly pick up their unsold/abandoned items. Invoices will not be refunded if you fail to pick up your items.
If a bidder is habitually unable to pick up their items despite paying on time, Southern Minnesota Auctions reserves the right to revoke the bidder's bidding privileges.
Please bring help, the proper tools, and the necessary equipment to load and secure your items as auction staff is typically busy during loadout times. For auctions held at our facility, a forklift is available to assist in loading large items from the ground level. There is no charge for this service. The Auctioneer, Southern Minnesota Auctions, and/or the property owner are not liable for injuries or damage during removal.
Failure to load your items by the end of the auction loadout will result in a $50/hour staffing charge (minimum 1 hour), payable in cash at the time of loadout.
It is your complete and total responsibility to ensure all items you won are present and accounted for in your vehicle before leaving the auction site.
If we are bringing items back to our warehouse from an auction held on the seller's premises, please read the directions carefully in regards to pickups. Additional fees will be applicable and pickup dates at the warehouse must be adhered to. Items that are marked "NO SHIPPING" will not be transported back to the warehouse in Nicollet.
SHIPPING
- To request shipping, simply email, call or text us.
- Items that are shipped need to paid for with a credit or debit card. We will not accept a check via mail for invoices that need to ship.
- Shipping is available on items as indicated. Please don't ask us to ship items that are marked "No Shipping" - there's a reason we have them marked as such.
- We ship using SpeeDee, FedEx, UPS or USPS. Carrier is determined by auctioneer's discretion.
- Ensure your address is correct on your invoice! If it comes back, we will reship it at your expense.
- We charge a minimum of $10.00 per package for packaging supplies and time + actual shipping charges. For items requiring more packing material and time, the handling will be higher.
- We have packaged thousands of items between our previous auction sales and our eBay store - we know what we're doing! We ensure everything is safely and securely packaged prior to sending it out. We've been accused of overpacking before, but we stick close to the "better safe than sorry" way of thinking. Requests to ship with minimal packing material will not be granted.
- Please let us know ASAP if you want insurance. You will be charged what the carrier charges for this service.
- The credit card you have on file will be charged with the shipping and handling fees.
- Southern Minnesota Auctions cannot be held responsible for items that have left our possession.

It is the winning bidder/buyer's sole responsibility to meet all governmental safety and environmental standards in removing, shipping and using purchased items. Certain items for sale may contain “hazardous substances,” as that term is defined under federal, state or local environment laws and regulations. Southern Minnesota Auctions has no duty to remove any hazardous substances that are contained in or are a part of any item. You – if a winning bidder or buyer – agree to indemnify, hold harmless and defend (by counsel satisfactory to Southern Minnesota Auctions in its sole discretion) Southern Minnesota Auctions, its affiliates and subsidiaries, and all of their respective directors, officers, members, employees, agents, shareholders, co-branders, partners, successors and assigns, and each of the foregoing, from any and all claims, causes of action, suits at law or in equity, judgments, liability, losses, damages, costs or expenses, including without limitation court costs and attorneys' fees, that are sought from or incurred by Southern Minnesota Auctions and that arise out of or relate in any way to the sale, removal, shipment or use of any purchased items.
Changes to Services and Website
You acknowledge and agree that Southern Minnesota Auctions may change, modify, amend, suspend, or discontinue any aspect of the Services, including the Website, at any time without notice and without liability to you or to any third party. Southern Minnesota Auctions also reserves the right to impose limits on certain features of the Services, including the Website, at any time, without notice and without liability to you or to any third party.
Changes or Amendments to Terms and Conditions, Terms and Conditions of Sale & Other Auction-Specific Terms and Conditions
You also acknowledge and agree that Southern Minnesota Auctions – at its sole discretion – may update, modify, or amend, in whole or in part, these terms and conditions (as well as fees and transaction rules set forth in the Terms and Conditions of Sale or and any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction) from time to time. Accordingly, you acknowledge and agree that, to the maximum extent permitted under the law, unless otherwise stated, any and each update, modification or amendment to these terms and conditions, Terms and Conditions of Sale, or any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction will fully govern your use of the Services, including the Website.
No Warranty
Use of the Services (including the Website) is at your own risk. As noted above, Southern Minnesota Auctions provides, in part, a service for buyers to bid through an online auction format. You acknowledge and agree that this service may not function properly at any given time. Accordingly, Southern Minnesota Auctions cannot be held responsible for server down time, or any inability to access our Website or Services. Under no circumstances shall you have any claim or cause of action against Southern Minnesota Auctions or anyone else if the Internet fails to work correctly at any time. Southern Minnesota Auctions is not responsible for any missed bids from any sources. Moreover, notifications sent by Southern Minnesota Auctions via email may possibly take longer than expected and cannot be counted on to inform you of an item's status. Further, in the event of any problems, we reserve the right to cancel, restart, or extend an item, or complete an auction as the circumstances may dictate in our sole discretion.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES (INCLUDING THE WEBSITE) ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH THE SERVICES (INCLUDING THE WEBSITE) WILL CREATE ANY WARRANTY. WITHOUT LIMITING THE FOREGOING, SOUTHERN MINNESOTA AUCTIONS DOES NOT WARRANT THAT ANY CONTENT OR INFORMATION ACCESSED THROUGH THE SERVICES OR WEBSITE IS ACCURATE OR CORRECT; THAT THE SERVICES (INCLUDING THE WEBSITE) WILL MEET YOUR REQUIREMENTS; THAT THE SERVICES (INCLUDING THE WEBSITE) WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICES (INCLUDING THE WEBSITE) ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES (INCLUDING THE WEBSITE) IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICES (INCLUDING THE WEBSITE).
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOUTHERN MINNESOTA AUCTIONS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CIRCUMSTANTIAL, CONSEQUENTIAL, CONTINGENT, EXEMPLARY, INCIDENTAL, INDIRECT, LIQUIDATED, PUNITIVE, SPECIAL, OR SPECULATIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, SALES OR REVENUES, LOST BUSINESS OR BUSINESS INTERRUPTION, USE, DATA OR OTHER INTANGIBLE LOSSES, OR ATTORNEYS’ FEES OR COSTS ARISING OUT OF OR RELATED TO THE SERVICES (INCLUDING THE WEBSITE), THIS AGREEMENT OR THE PERFORMANCE OR BREACH THEREOF, REGARDLESS OF WHETHER LIABILITY IS ASSERTED IN CONTRACT, TORT, OR OTHERWISE OR WHETHER SOUTHERN MINNESOTA AUCTIONS HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. Neither Southern Minnesota Auctions nor Seller shall be liable for any damages of any type or nature (whether in contract, tort or otherwise) sustained or claimed by you or any other person or entity in connection with the SERVICES OR WEBSITE.
ADDITIONALLY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND WITHOUT LIMITING THE FOREGOING, SOUTHERN MINNESOTA AUCTIONS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES (INCLUDING THE WEBSITE); (III) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICES (INCLUDING THE WEBSITE) AND/OR ANY AND ALL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES (INCLUDING THE WEBSITE); (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES OR WEBISTE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES OR WEBSITE; AND/OR (VII) USER DATA OR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
FURTHERMORE, Without limiting the foregoing, in no event shall Southern Minnesota Auctions’ liability to YOU for any act or omission occurring in connection with the SERVICES (IF ANY) exceed the amount that YOU HAVE ACTUALLY paid to Southern Minnesota Auctions as a deposit or as payment for a purchased item.
Assignment
This Agreement, including your rights and obligations herein, cannot be transferred or assigned by you, but may be assigned by Southern Minnesota Auctions without restriction. Any attempt by you to transfer or assign this Agreement, or any of your rights or obligations hereunder, shall be null and void.
Class Action/Jury Trial Waiver
WITH RESPECT TO ALL PERSONS AND ENTITIES, REGARDLESS OF WHETHER THEY HAVE OBTAINED OR USED THE SERVICE OR WEBSITE FOR PERSONAL, COMMERCIAL OR OTHER PURPOSES, ALL CLAIMS, CAUSES OF ACTION OR DEMANDS MUST BE BROUGHT IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.
Applicable Law, Forum and Attorneys’ Fees and Costs
This Agreement, the Terms and Conditions of Sale, and any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction (for purposes of this paragraph, individually and collectively, hereinafter referred to as the “Agreements”) shall be interpreted in accordance with the substantive laws of the state of Minnesota, without giving effect to conflict-of-laws principles. You and Southern Minnesota Auctions agree that the exclusive venue for any claims, disputes, proceedings, or causes of actions arising under or in relation to the Agreements shall be in Anoka County, Minnesota, or in the United States District Court for the District of Minnesota. You expressly consent to personal and exclusive jurisdiction in the courts of the state of Minnesota located in Nicollet County and in the United States District Court for the District of Minnesota. You further waive any defense of inconvenient forum as to any such Court, and agree not to bring any dispute, claim, lawsuit, action, or proceeding arising out of or related to the Agreements in any other Court. You also waive any bond, surety or other security that might be required of Southern Minnesota Auctions in any action or proceeding, and further consent to service of process under Minnesota law. If you breach any of the terms of the Agreements or you sue Southern Minnesota Auctions and Southern Minnesota Auctions is the prevailing party, you shall be liable for and reimburse Southern Minnesota Auctions for the attorneys’ fees and costs Southern Minnesota Auctions incurs in or related to any lawsuit commenced to enforce any portion of the Agreements or incurs in responding to or defending against claims or causes of action asserted by you against Southern Minnesota Auctions. Any decision regarding attorneys’ fees and costs shall be made by the judge.
For purposes of foregoing paragraph and any Seller Contract or Seller Affiliate Contract, any party who enters into a Seller Contract or Seller Affiliate Contract with Southern Minnesota Auctions hereby agrees that the term “Agreements” in the foregoing paragraph includes the Seller Contract and Seller Affiliate Contract, as applicable, and that the term “you” in this paragraph/section includes sellers and seller affiliates.
Severability, Waiver, and Survival
If any provision in or obligation under the Agreement, the Terms and Conditions of Sale, and any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction shall be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions or obligations shall not in any way be affected or impaired thereby. The waiver of any provision or condition or the breach of any term will not be a waiver of any subsequent breach of the same or any other term or condition. This Agreement constitutes the complete and final integrated agreement between the parties in regard to the specific terms contained herein. This Agreement, the Terms and Conditions of Sale, and any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction shall be binding upon and inure to the benefit of the parties and their respective heirs, personal representatives, successors, and allowable assigns (if any). The acknowledgements, covenants and obligations of the parties set forth in this Agreement, the Terms and Conditions of Sale, and any other applicable terms and conditions established by Southern Minnesota Auctions and specific to the pertinent auction shall survive the expiration or termination of the same, as amended, and delivery of the Services, unless inapplicable by their terms.

You understand that by using the Services, including the Website, Southern Minnesota Auctions collects, uses and discloses your personal information and aggregate and/or anonymized data as set forth in our Privacy Statement found here.
