Joe Fickas spent many years serving our country in the military. Here at home, he and his wife brought joy to countless families through their years as owners of the Mt. Vernon Flower Shop, helping people celebrate life’s milestones and honor loved ones.

We’re honored to help the Fickas family offer items from Joe’s estate in this online auction. The catalog features antiques, home furnishings, glassware, hunting items, and more, with a wide variety of pieces ready for their next chapter.

Auction Terms

These Terms and Conditions (the “Terms”) govern participation in online personal property auctions conducted by Southern Trust Auction Realty, an Indiana DBA of Southern LLC (“STAR,” “Auctioneer,” “we,” “us”). By registering to bid, placing a bid, or completing a purchase, the bidder (“Bidder,” “Buyer,” “you”) acknowledges having read, understood, and agreed to these Terms in full. If you do not agree, do not bid.

1. Auction Format and Acceptance

This is an online-only auction. Lots are offered for sale through the auction software platform identified on the auction listing. The Bidder accepts these Terms by registering an account, submitting a bid, or otherwise participating in the auction. Any additional terms specific to a particular auction (the “Sale-Specific Terms”) are incorporated by reference and control where they conflict with these Terms.

2. Bidder Eligibility and Registration

1.   Bidders must be at least eighteen (18) years of age and legally capable of entering into a binding contract.

2.   Bidders must register with accurate name, address, telephone, email, and a valid payment method. STAR may verify identity, run credit-card pre-authorization, or require a refundable deposit before approving a registration.

3.   STAR reserves the right, in its sole discretion, to deny, suspend, or revoke any registration, to reject any bid, and to refuse service to any person, with or without cause.

4.   Bidder accounts are non-transferable. The registered Bidder is solely responsible for all activity placed under that account, including bids placed by anyone using the Bidder’s credentials.

3. Auction Method and Bidding

5.   Bids are binding offers to purchase. Once submitted, a bid cannot be retracted, reduced, or canceled by the Bidder.

6.   Maximum (proxy) bids are placed in confidence by the platform on the Bidder’s behalf, advancing only as needed to maintain the high-bid position up to the Bidder’s stated maximum.

7.   A soft-close (extended bidding) may apply. If a bid is placed within the published soft-close window, the lot’s closing time will extend by the published interval to allow other Bidders a fair opportunity to respond.

8.   In the event of tie maximum bids, the bid received first by the platform shall prevail.

9.   STAR may, at its sole discretion, reopen bidding, reoffer a lot, group or split lots, withdraw any lot before the hammer, or cancel an auction in whole or in part.

10.  STAR is not responsible for missed bids, system delays, internet outages, or platform errors. Bidders are encouraged to bid early and not to rely on last-second bidding.

4. Reserve, No Sale, and Seller Bidding

 

Lots may be offered with or without reserve as stated in the Sale-Specific Terms. Where a reserve applies, STAR is not obligated to sell the lot if the reserve is not met. The seller, the seller’s agents, and STAR shall be allowed to bid on items for personal purchase.

5. Buyer’s Premium

A ten percent (10%) Buyer’s Premium will be added to the high bid (hammer price) of each lot to determine the contract sale price. Sales tax, payment processing fees, and other applicable charges are calculated on the contract sale price (hammer plus Buyer’s Premium) where required by law.

6. Condition of Property; AS-IS, WHERE-IS

11.  All property is sold AS-IS, WHERE-IS, with all faults, and without any warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, authenticity, year, model, mileage, hours, condition, completeness, or value.

12.  Catalog descriptions, photographs, measurements, and lot numbers are provided as a courtesy and are not warranties. The Bidder is solely responsible for inspecting the property, performing due diligence, and verifying any fact material to the bidding decision before placing a bid.

13.  In-person preview is offered when feasible and is announced in the Sale-Specific Terms. Failure to inspect does not relieve the Bidder of any obligation under these Terms.

14.  STAR is not the manufacturer, importer, or rebuilder of any lot. The Bidder assumes all risk associated with the use, operation, transport, repair, and resale of any lot purchased.

7. Payment

Payment is due in full no later than 5:30 PM Central Time on the day of the auction item pickup, unless a different deadline is stated in the Sale-Specific Terms. Title to a lot does not transfer until payment is received in full as cleared funds.

7.1 Accepted Payment Methods

•    Cash, paid in person at pickup, in U.S. dollars.

•    Personal or business check, accepted at STAR’s discretion. Property may not be released until funds are confirmed.

•    Credit card or debit card. A non-refundable processing fee of three and two-tenths percent (3.2%) will be added to all card transactions to offset processing costs. By electing card payment, the Bidder authorizes STAR to charge the registered card for the contract sale price, applicable taxes, and the processing fee.

7.2 Required Payment Methods for Titled and Higher-Value Lots

Wire transfer, cash, or certified funds (cashier’s check or bank-issued certified check) are required for: (a) any lot involving titled property, including but not limited to vehicles, trailers, watercraft, motorcycles, ATVs/UTVs, and similar titled craft; and (b) any single transaction (or combined invoice) totaling more than two thousand five hundred dollars ($2,500.00). Personal checks and credit/debit cards will not be accepted for these transactions. Wire instructions are issued only by STAR and only by a confirmed STAR email address; the Bidder is responsible for verifying wire instructions by phone before sending funds.

7.3 Charge Authorization

By registering a payment card, the Bidder authorizes STAR to (i) place pre-authorization holds, (ii) charge the card for any winning bids and associated fees and taxes, and (iii) charge the card for any unpaid balance, default fees, chargeback losses, recovery costs, or other amounts owed under these Terms.

8. Sales Tax and Exemptions

Indiana sales tax and any other applicable state or local tax will be collected on all taxable lots at the rate in effect on the auction close date. Bidders claiming a tax exemption (resale, agricultural, nonprofit, or otherwise) must submit a properly completed Indiana exemption certificate (Form ST-105 or its successor) before payment is processed. Tax already collected will not be refunded after payment without a valid exemption certificate on file.

9. Removal, Pickup, and Shipping

9.1 Pickup Window

The pickup location, date(s), and hours are stated in the Sale-Specific Terms. Buyer is responsible for arriving prepared with the labor, vehicles, tools, packing materials, and assistance needed to load and remove the property. STAR personnel are not responsible for loading and assume no liability for property damage or personal injury that occurs during loading.

9.2 Third-Party Shipping

STAR does not provide in-house packing or shipping. Buyers who cannot pick up in person will pay a third-party shipper at the Buyer’s sole cost, risk, and expense. The Buyer is responsible for providing STAR with written authorization to release the lot to the third-party shipper via email request. Title and risk of loss pass to the Buyer at the moment property is released to the Buyer or to the Buyer’s shipper, whichever occurs first. STAR is not the Buyer’s agent for shipping and disclaims all liability for loss, damage, delay, or insurance coverage in transit. Buyers needing Shipping shall send a return email to from their invoice email, stating they will need their item shipped. A Star Representative will contact the bidder to arrange shipping/payment for shipping.

9.3 Failure to Remove

Property not removed by the close of the published pickup window may be assessed a storage fee of $10 per lot per day, deemed abandoned at STAR’s discretion after seven (7) calendar days, and resold or disposed of without further notice. The original Buyer remains liable for the contract sale price, taxes, fees, storage charges, and any deficiency between the original sale and any resale.

10. Default

A Bidder is in default if any of the following occurs: (a) failure to pay the contract sale price, taxes, or fees by the stated deadline; (b) a payment is reversed, charged back, or returned for insufficient funds; (c) failure to remove property within the pickup window; or (d) any material breach of these Terms.

In the event of default, STAR may, at its option and without further notice: (i) charge the Bidder’s registered card for the full balance owed; (ii) cancel the sale and resell the property by any commercially reasonable method, with the defaulting Buyer liable for any resale deficiency, costs, and reasonable attorneys’ fees; (iii) assess a default fee equal to the greater of $250.00 or twenty percent (20%) of the contract sale price; (iv) ban the Bidder from future STAR auctions; and (v) report the default to the auction software platform and to credit or collection agencies. Late balances accrue interest at one and one-half percent (1.5%) per month or the maximum rate permitted by Indiana law, whichever is less.

11. Title and Risk of Loss

Title to personal property passes upon STAR’s receipt of cleared payment in full. Risk of loss passes upon release of the property to the Buyer or the Buyer’s shipper, whichever occurs first. For titled property, the certificate of title and any required documents will be transferred to the Buyer of record listed at registration after cleared funds are received; STAR will not split, reassign, or backdate titles.

12. Online Bidding Disclaimer

Online bidding depends on internet connectivity, third-party software, and electronic systems beyond STAR’s control. STAR does not warrant that the auction software will be uninterrupted, error-free, or compatible with any specific device or browser. STAR is not liable for missed bids, lost connections, software bugs, latency, scheduled or unscheduled platform downtime, or for any bid placed in error. The clock and bid log of the auction software are the official record of the auction and control over any other display or notification.

13. Limitation of Liability

To the fullest extent permitted by law, the total liability of STAR, its members, employees, agents, contractors, and the seller, arising out of or relating to any lot, the auction, or these Terms, is limited to the amount actually paid by the Buyer to STAR for the lot in question. In no event shall STAR be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, even if advised of the possibility of such damages.

14. Indemnification

The Buyer agrees to indemnify, defend, and hold harmless STAR, its members, employees, agents, contractors, and the seller from and against any claim, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to (a) the Buyer’s use, operation, transport, storage, or resale of any lot purchased, (b) the Buyer’s violation of these Terms or any applicable law, or (c) any act or omission of the Buyer or the Buyer’s shipper, agents, or invitees at any auction-related premises.

15. Communications and Privacy

By registering to bid, the Bidder consents to receive auction-related communications from STAR by email, text message, or telephone, including outbid notices, invoices, pickup reminders, and future auction announcements. The Bidder may opt out of marketing messages at any time by replying STOP or by contacting STAR. STAR’s collection and use of personal information is governed by the privacy notice posted at sotrustar.com.

16. Recording and Use of Likeness

Pickup locations may be monitored by video or audio recording for security and dispute-resolution purposes. By entering a pickup location, the Buyer consents to such recording and to STAR’s use of the recording for any lawful business purpose.

17. Governing Law, Venue, and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the auction or these Terms shall be brought exclusively in the state or federal courts located in Posey County or Vanderburgh County, Indiana, and the parties consent to personal jurisdiction and venue in those courts. THE PARTIES WAIVE ANY RIGHT TO A TRIAL BY JURY. Any claim must be brought within one (1) year after the cause of action accrues or be forever barred.

18. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with any Sale-Specific Terms, constitute the entire agreement between STAR and the Bidder regarding the auction and supersede all prior or contemporaneous understandings on the subject. STAR may amend these Terms at any time by posting the amended Terms on sotrustar.com or on the auction software platform; continued bidding constitutes acceptance of the amended Terms.

19. Auctioneer Role

STAR represents the seller, not the Buyer. The auction is a method of market-value discovery in which qualified Bidders compete on a transparent, time-defined basis to establish the price of property. Nothing in these Terms creates a fiduciary, employment, or agency relationship between STAR and the Bidder.

20. Bidder Acknowledgment

By registering to bid in this auction, the Bidder acknowledges that they have read these Terms in full, that they understand each provision, that they agree to be bound by the Terms as a binding contract, and that they have had the opportunity to seek independent legal or financial advice before bidding.
